At its most basic, mediation is the process of having a neutral third party attempt to help the parties resolve their dispute. The neutral, called a mediator, does not have any authority over the parties and does not issue a decision or judgment like a judge or arbitrator is called upon to do.

Litigation and trials are costly and unpredictable. Even when one “wins,” it is rarely if ever a complete victory and it always comes at a cost. Mediation can be the Parties’ best (and sometimes only real) opportunity to control the outcome of a dispute.

Kevin R. Allen brings over seventeen years of experience as a California trial lawyer. During his career, he litigated all types of civil disputes including those involving family law, real property, personal injury, and employment cases. A majority of his litigation practice focused heavily on California wage and hour class actions and representative claims under the Private Attorneys General Act (“PAGA”).

He received training on negotiations from the Strauss Institute for Dispute Resolution. He’s completed Mediating Disputes offered by the Program on Negotiation (PON) at Harvard Law School. As a class action attorney he also routinely mediated cases with probably some of the best mediators around.

Wage and Hour Class Actions and Representative Cases Under PAGA/FLSA

As a lawyer Kevin R. Allen spent a majority of his practice litigating California wage and hour class actions. He was retained by employers and employees alike. He frequently cocounseled with plaintiffs’ firms.

Kevin R. Allen has also litigated dozens of representative employment matters including claims for penalties under California’s Private Attorneys General Act and collective actions under the Federal Labor Standards Act (FLSA).


Commercial Disputes Including “Business Divorces”

Kevin R. Allen has represented and advised employees and employers dealing with misappropriation of trade secrets and unfair composition type claims. He has assisted business owners in disputes with other owners. He has negotiated severance agreements. He has negotiated and arbitrated claims arising from leases and real estate transactions including professional negligence claims.
